The Department of Labor has released a new Employee Rights poster with information about the new emergency paid sick leave and family leave options created by the Families First Coronavirus Response Act (FFCRA). FFCRA requires employers with 500 or fewer employees to provide emergency paid sick leave and family leave to certain employees impacted by COVID-19. Each covered employer must post a notice of the Families First Coronavirus Response Act (FFCRA) requirements in a conspicuous place on its premises by April 1, 2020. An employer may satisfy this requirement by emailing or direct mailing this notice to employees, or posting this notice on an employee information internal or external website. Employers are well-advised to post this notice in a physical location or locations AND provide electronically via email or company intranet. This is especially important if workers are working remotely, either on a permanent or temporary basis. Employers who are exempt from FFCRA's requirements for any reason (such as those with more than 500 employees) should not post or provide this notice to employees as it could potentially create an obligation or expectation where the law does not require.
